Buyer Right to Cancellation: You may cancel this contract without any penalty or further obligation with written notice by e-mail, certified, or registered mail provided to STATS Gym c/o Aquila within (3) days from the agreement date only. Your membership starts today.

2. TERM
BUYER/MEMBER HEREBY ACKNOWLEDGES RECEIPT OF A FULLY COMPLETED COPY OF THIS AGREEMENT EXECUTED BY BOTH MEMBER/BUYER AND SELLER. MEMBER/BUYER AND SELLER EACH ACKNOWLEDGE THE ADDITIONAL MEMBERSHIP AGREEMENT TERMS SET FORTH ON THE FOLLOWING PAGES. I understand that this agreement is for a minimum of twelve months, during which time membership may be terminated at any time with 30 days written notice by e-mail, certified or registered mail to Aquila.
3. WAIVER & RELEASE
I, understand that I will not be allowed access to the STATS Gym or the locker rooms serving the facility (“Fitness Center”) unless I read, sign and deliver to Aquila Fitness Consulting Systems, Ltd. (“Aquila”) this Membership Agreement & other Informed Consent and Release, Member Handbook, and Rules.
I recognize that participation in the activities offered at the Fitness Center is strictly voluntary and acknowledge that some of the activities in which I will participate may be of hazardous nature and include strenuous physical exercise or activity. Recognizing this, I hereby certify that, to the best of my knowledge, I do not have any medical, physical, mental, or emotional health condition that would hinder or prevent my active participation in such activities. I agree to complete and sign a Pre-Activity Fitness Profile Form before participating in any exercise activities at the Fitness Center.
In consideration of my request to participate in the activities offered at the Health Facilities, I acknowledge and agree to the following:
1. I hereby release and hold harmless the STATS Gym, Fitness Association of the U.S. Census Bureau (FABOC), U.S. Bureau of the Census, Bureau of Economic Analysis, Bureau of Labor Statistics, and Aquila Fitness Consulting Systems Ltd., its agents, employees, and independent Contractors from any and all liability, damage, expense, causes of action, suits, claims or judgments, arising from injury, damage or loss, or claims of injury, damage or loss to me or my personal property which may arise out of my use of the STATS Gym facility and/or their independent Contractors.
2. I hereby assume full responsibility for all risk of injury or loss, which may result from my participation in the activities offered by Aquila, STATS Gym.
3. I agree to indemnify and hold harmless, release and forever discharge, the STATS Gym, Fitness Association of the U.S. Census Bureau (FABOC), U.S. Bureau of the Census, Bureau of Economic Analysis, Bureau of Labor Statistics, and Aquila Fitness Consulting Systems Ltd., and their affiliates and instructors (and their respective partners, officers, agents, employees, and other representatives of any of the foregoing) from any and all acts of negligence and all claims and demands whatsoever, which I, any third person, or any persons acting on their behalf, have or may have against any of said indemnified parties, by reason of any accident, illness, injury or death of any person or persons, or damage to or loss, theft or destruction of any property, arising or resulting directly or indirectly from participation in the activities offered by the STATS Gym and occurring during said participation, or any time subsequent thereto.
4. I represent and warrant to Aquila, its contractors and instructors, that the answers I have given in my Pre-Activity Fitness Profile Form are true and accurate.
5. The terms of this Release will serve as a release and assumption of risk for me and my heirs, executors, and administrators and for all my family members. If contractors and/or instructors are utilized at the Health Facilities, they shall be covered by this release without regard to the nature of such contractors’ or instructors’ relationship, if any, to Aquila.
6. Nothing herein shall be construed as a waiver of any rights or benefits, which would otherwise be available under any applicable medical or Worker’s Compensation insurance carried by or for the benefit of the undersigned participant.
7. Aquila reserves the right to exclude anyone from the Health Facilities, for any reason, including but not limited to situations in which such person’s continued use may be dangerous, any inappropriate behavior, or violations of rules which may be established from time to time.
PLEASE NOTE THAT AQUILA STRONGLY RECOMMENDS THAT EACH PARTICIPANT HAVE SOME TYPE OF ACCIDENT MEDICAL INSURANCE FOR HIS/HER OWN PROTECTION AND OBTAIN A PHYSICIAN’S RELEASE FOR EXERCISE.
I understand and acknowledge that we have no expertise in diagnosing, examining, or treating any medical conditions. I agree not to use STATS Gym with any medical condition, including open cuts, abrasions, sores, infections, maladies or inability to maintain personal hygiene. It is your responsibility to consult with your physician to determine if any these medical conditions exists and, if so, whether such condition poses a direct threat to the health or safety of yourself or others. The club reserves the right to make the final determination.
4. MEMBERSHIP RULES
You agree to follow all rules and regulations now in force or in the future adopted by us. Membership Rules are attached to this Agreement.
5. GOVERNING LAW
This Contract is governed by the laws of State of Maryland
6. RESERVATION OF RIGHTS
We reserve the right at any time to alter the hours of operation, and the right to amend the cost of, add, modify and/or eliminate any program, facility, activity, class or service of any club, in our sole discretion. Classes and equipment are available subject to demand and may be crowded at peak hours or may be discontinued or times changed if demand fluctuates.
7. APPEARANCE AGREEMENT
I understand that as a participant in the Fitness Center, I may be included in recordings, streaming, videotapes, photographs, testimonials, DVDs, podcasts, and videocasts taken during my use of the facility and services. Therefore, without reservation or limitations, I, in my own behalf hereby assign, transfer and grant to STATS Gym and AQUILA, its successors, assignees, licensees, sponsors, any television networks, and all other commercial exhibitors the exclusive right to photograph and/or videotape myself and to utilize such videotapes and photographs and my name, face, likeness, voice and appearance, in advertising and promoting the Fitness Center or in advertising and promoting similar future events, and for any other use or purpose whatsoever, without reservations and limitations. I further understand that neither STATS Gym, AQUILA nor any third party is under any obligation to exercise any of the foregoing rights, licenses and privileges.
8. SEVERABILITY
If any part of this agreement shall be held invalid, that part shall be deemed excluded from this agreement and the remainder of this agreement shall remain in full force and effect.
9. MEMBERSHIP CANCELLATION & REFUNDS
You may cancel your membership with a 30-day notice by filling out a cancellation request form and/or stop payroll deduction form. Refunds for payments will be given only because of the following: (1) Military Furlough or (2) Injury or extended illness with a doctor’s note. Other refund requests might be reviewed on a case-by-case basis.
ADDITIONAL RIGHTS TO CANCELLATION; You may also cancel this contract with 30 days written notice by certified or registered mail for any of the following reasons: a) If upon a doctor’s order, you cannot physically receive the services because of significant physical disability for a period more than six months. b) If you die, your estate shall be relieved of any further obligation for payment under the contract not then due and owing. c) If, within the first twelve months of your membership, your employment is involuntarily terminated without cause.
10. PRIVACY NOTICE
STATS GYM and AQUILA are committed to protecting the privacy and personal information of our members. This Privacy Notice outlines how we collect, use, store, and protect your data in accordance with applicable privacy laws, including but not limited to the General Data Protection Regulation (GDPR) and other relevant data protection legislation.

• Full name, date of birth, and contact information (e.g., email address, phone number, mailing address)
• Payment and billing details
• Emergency contact information
• Health or medical information provided for fitness assessments, personal training, or safety purposes

• Fitness Center incidents, medical emergencies

Your personal data is collected and used for the following purposes:
• To create and manage your membership account
• To process payments and manage billing
• To communicate with you regarding your membership, classes, and services

• To send emergency notifications
3. Data Security
We have implemented appropriate technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. These include secure data storage, access controls, encryption, and regular staff training on data privacy.
4. Sharing Your Data
We do not sell or rent your personal data to third parties. Your information may be shared only with trusted service providers who assist us in operating our business (e.g., payment processors, IT services), and only under strict confidentiality agreements.

You have the right to:

STATS Gym Rules & Regulations

1. Must be a Federal Employee, Federal Contractor, or Intern to join. Must complete release and waiver forms to use the gym.
2. All Participants MUST check-in by scanning their barcode BEFORE using the center.
3. Lockers are for use during workouts only; personal items may not be stored at any other time. A warning notice will be placed on lockers after 1 day and locks will be cut off after 3 days if items remain in a non-rental locker
4. Lost and found items are placed in a bin outside of the locker rooms. Once the bin is full, the lost and found items are sent to GSA’s lost and found office.
5. Showers and locker rooms are for members only and individuals purchasing a 1-day pass.
6. No guests are permitted without purchasing a 1-day pass.
7. Water and sports drinks in closed/sealable plastic containers are the only consumables permitted in the fitness center.
Clean any spills and notify fitness specialists if safety issues arise. Alcohol is strictly prohibited.
8. Please use sign up board when any cardiovascular equipment you wish to use is not available. Observe the 30-minute limit when others are waiting.
9. Please refrain from excessive noise (i.e. grunting, yelling, etc.) during your workout.
10. Allow others to "work-in" on strength training equipment when you are doing multiple sets. If another member is waiting for a piece of equipment you wish to use, please let them know you wish to work in.
11. Please do not occupy equipment you are not using.
12. Replace all equipment to its proper storage area. This includes dumbbells, barbells, plates, yoga mats and blankets, balls, tubing and other small moveable items.
13. Please read equipment safety and instructional signs carefully before using machines. Use the equipment as it is intended to be used. Insert weight pins fully into weight stacks. Do not use add-on weights or other objects or training aids unless provided by the facility and intended specifically for such use.
14. Participants with out-of-date payment or health information will be asked to update paperwork before using the facility.
15. As a respect to fellow members and the fitness center staff, threatening actions, profanity, and grossly rude conduct WILL NOT be tolerated. Members in violation will be removed from the fitness center and his/her membership may be canceled. A temporary suspension of membership may ensue during an investigation.
16. Please note that there may be the occasional unforeseen closures of the facility. All group exercise participants must abide by protocols and procedures, including but not limited to arriving on time to class. No member will be admitted after the warmup has ended.
17. Stop exercise if you feel weak, faint, nauseous, or unduly tired or uncomfortable.
18. In the event towel service returns, members may use one bath and one hand towel per visit. Soiled linens are placed in designated towel drop bins. Immediately return any towels accidently taken home or to a workstation.
19. Smoking, vaping, and the consumption of tobacco products in STATS gym is strictly prohibited.
20. Wear appropriated sneakers, not open-toed shoes, sandals, or clogs. Neither street shoes nor black-soled shoes of any kind are permitted on the STATS gym’s group exercise floor.
21. A full-length shirt or tank top is required over a sports bra. Avoid wearing oversized garments.
22. Please do not bring in or consume food.
23. Failure or refusal to comply with these rules and regulations may result in loss of STATS gym membership privileges and use.
Pre-Activity Fitness Profile
This form is not a substitute for a thorough physical examination, assessment and diagnosis by your physician. It is designed to identify adults for whom physical activity might be inappropriate at this time. Aquila strongly recommends that each client undergoes a medical examination before beginning any exercise programs.

Acknowledgment of Participation and Assumption of Risks
I declare my intent to voluntarily participate in the activities, facilities, programs, and services offered by Aquila Fitness Consulting Systems, Ltd. I understand that each individual, including myself, has varying capacities for engaging in such activities, and I acknowledge that all offerings are educational, recreational, or self-directed in nature. I assume full responsibility for my choices to participate, including any application of the information or instruction I receive, both during and after my involvement. I recognize
that my participation carries inherent risks, which are influenced by my personal fitness, health (physical, mental, or emotional), and the care, awareness, and skill with which I conduct myself. I accept and assume these risks voluntarily.
Potential Risks and Symptoms
I understand that participating in the activities, facilities, programs, and services of Aquila Fitness Consulting Systems, Ltd. may involve certain risks, including but not limited to:
• Transient light-headedness, fainting, abnormal blood pressure, chest discomfort, leg cramps, and nausea.
• Musculoskeletal risks such as sprains and strains.
• Cardiovascular and respiratory risks such as dizziness, fainting, abnormal heartbeats, breathing discomfort, high or low blood pressure, and, in rare cases, heart attack or stroke.
I acknowledge that I may experience these or other symptoms during or after participation. I understand that I may stop or delay participation in any activity at my discretion and that I may also be instructed to stop by a supervising employee if symptoms of distress or abnormal responses are observed.
Health Certification
I certify that, to the best of my knowledge, I have no medical conditions (other than those disclosed on my fitness profile questionnaire) that would increase my risk of illness or injury because of participation in physical activities or a regular exercise program. I understand that completing this form does not constitute a medical diagnosis or serve as a substitute for consultation with my personal healthcare provider. I agree to consult my healthcare provider for any evaluation of my health status.
Waiver and Release of Liability
In consideration of my voluntary participation, I hereby waive, discharge, absolve, hold harmless, and forever release Aquila Fitness Consulting Systems, Ltd., its employees, officers, agents, representatives, and associated parties from all liability for any accident, injury, or loss arising from my use of their facilities, activities, programs, or services.

This Member Handbook is designed to assist you in enjoying the Suitland Train and Tone Studio (STATS gym) to the fullest. Please read the gym’s policies and guidelines in order to take advantage of your membership and all the services it has to offer.

Rules and regulations for STATS gym use are established and enforced by its Board of Directors. The power to enforce these rules and regulations extends to Aquila.
All members and guest pass holders must comply with the following rules and policies.
Operating Hours
Open weekdays and closed on federal holidays.

General Facility Policies
Food and Beverage
No food or beverage will be consumed in the locker rooms, exercise room, or group exercise studio except during special events sponsored by the fitness center or in designated areas. Plastic water bottles are permitted.
Smoking
Smoking and vaping are absolutely prohibited within the confines of the fitness center as is any form of tobacco use.
Attire
While using the fitness center, proper attire—shorts, T-shirts, sweatshirts, a full-length shirt over a sports bra or tank top, warm-up suits, leggings, or tights—are required. Oversized garments and business attire are not permitted.
Shoes
Athletic shoes are required. Neither street shoes nor black-soled shoes of any kind are permitted on the STATS gym’s Group Exercise floor. Open-toe shoes, sandals, clogs are not permitted.
Guest Policy
Non-members may purchase a 1-day guest pass. All guests must complete a health waiver and have a heart rate and blood pressure measured prior to exercise.
Showers
Showers are exclusively for use by STATS members and 1-day guest pass holders.
Body wash is provided for members. Showers are to be kept to a reasonable length of time (not to exceed 10 minutes). Members shall bring their own towels. Hanging wet clothes, socks, etc. to dry in the locker room or lockers is not permitted.
Exercise Room and Equipment
Clearance must be obtained from Aquila before using the equipment. Members shall use the equipment in accordance with instructions provided by Aquila. Between the hours of 11 AM and 1:30 PM, there is a 30-minute time limit on the cardiovascular equipment if others are waiting. Members are required to return all free weights they use to the appropriate weight rack.
Music
All personal music devices used in the exercise room shall be permitted only with the use of earphones.
Group Exercise Floor / Classes
Class schedules are established by Aquila in conjunction with FABOC’s Board of Directors. Scheduled classes have priority use of the Group Exercise floor. Prior approval must be obtained from Aquila to conduct independent exercise sessions involving five or more participants on the Group Exercise floor.
Lost and Found
Items that are lost and found are located at the front desk. Items placed in the lost and found are retained for one month. After one month, all unclaimed items are discarded. All jewelry or valuable items (as determined by Aquila) will be placed under lock and key until claimed. Aquila and the Board of Directors will not be held responsible for items placed in the lost and found.
Emergency Evacuations
In the event of an emergency evacuation, all participants must exit the fitness center and follow instructions for where to report. Participants failing to evacuate the fitness center during emergencies will result in membership revocation.
FABOC Membership Policies
Membership Eligibility
The FABOC has the following membership categories:
1. Regular Membership: Employees of the Bureau of The Census, BEA, BLS, (including part time, full time, temporary, or regional office employees) and Contractors. Regular members have full voting rights.
2. Temporary Membership: Any Census regional office employee or Census, BEA, or BLS student/intern employee retained for short, limited periods of time. Temporary members do not have voting rights.
3. Special Membership: Membership may be extended to other groups of individuals at the discretion of the Board of Directors.
The FABOC shall be open to all federal employees who qualify as members. Each member will possess all the rights and privileges and have access to programs and activities generally accorded or made available to that membership category, subject only to any conditions or limitations set by the contractor in conjunction with a duly authorized physician.
Membership Status
A STATS gym membership shall be granted to all individuals who fall within the aforementioned categories upon payment of an initiation fee and membership dues. If employment status changes during a membership term in which the member no longer meets the membership eligibility, membership will be terminated immediately. If the STATS gym membership becomes filled to capacity, the Board of Directors reserves the right to discontinue membership sales and establish a waiting list until space becomes available.
Fitness Assessment
New STATS gym members must receive a complete fitness assessment prior to use of the facilities. The fitness assessment is designed to help Aquila staff evaluate the current fitness levels of new members and to prescribe individual programs based on new members’ goals.
Areas of measurement include:
• Cardiovascular/Aerobic Capacity
• Muscular Strength
• Muscular Endurance
• Flexibility
• Percentage of Body Fat
• Resting Pulse and Blood Pressure
Individual Exercise Program
Each component of a member’s fitness assessment is thoroughly evaluated and recorded. These data, combined with health history questionnaire responses, enable Aquila’s team to design a complete individualized exercise program with the person’s specific goals in mind.
Membership Orientation
A facility orientation is mandatory before membership commences. Orientations are conducted by appointment following a fitness assessment.
Membership Payments
Membership will be established by an initiation fee and dues paid monthly. These rates are determined by the Board of Directors. Members pay with credit cards, check, or cash.
Membership Billing
If the membership is not paid after one month past the due date, membership will be canceled. After this time, reinstatement of membership will involve paying a $25 initiation fee along with regular membership dues.
Membership Cancellation
Any member wishing to cancel their STATS gym membership must register their written cancellation request with Aquila. It will take up to two weeks for membership to be terminated. Additionally, there will be no extensions or suspensions on any membership payments.
The initiation fee is nonrefundable.
Membership Identification
When entering the fitness center, all members must scan their STATS gym barcode ID. This process ensures access to the gym. A membership barcode ID may be used only by the member to whom it was issued.
Grounds for Revoking or Suspending Membership
The FABOC Board of Directors reserves the right to suspend and/or revoke any member/membership for violating any rule or regulation set by the FABOC Board of Directors.
Suspension: The FABOC Board of Directors will set the period of suspension based on the type and degree of violation. A $35.00 penalty fee will be assessed to a suspended member. A member can be suspended twice. On the third violation, regardless of reason, membership is permanently revoked and all prepaid fees are forfeited.
Lockers
General Policies
Lockers are exclusively for use by STATS members and 1-day guest pass holders.
It is advised to lock belongings in a locker with a personal padlock during workouts and, to be safe, leave valuables at home. FABOC and Aquila are not responsible for any lost, damaged, or stolen items. Gym bags are not allowed in the exercise spaces.
FABOC and Aquila are also not liable for replacing padlocks cut when a member forgets the lock’s combination, passcode, or key or leaves personal items in daily use lockers overnight or rental lockers past the renewal date.
“Daily use” lockers may be used during each fitness center visit by members and individuals who purchase a 1-day pass. All personal belongings and padlocks must then be removed after workouts and are not to be left overnight. A violation notice will be placed on daily use lockers in noncompliance followed by the removal of items. Neither FABOC nor Aquila will be held responsible for items placed in the lost and found as a result of this violation.
“Rental lockers” are limited and available on a first come, first served basis. When applicable, a rental locker wait list will be made available. Locker rentals are renewed annually.
Towels
General Policies
Towels are an amenity that may be provided as membership levels reach milestones set by the Board. Towels are provided at the entrance of men’s and women’s locker rooms.
Place used towels in the orange towel drops located in the towel shelves’ counter tops at locker room entrances. As towel supply is limited, members are encouraged to limit
themselves to one small and one large towel per visit.
Bad Weather Policies
Notification of Government Closing
The fitness center must be notified if the government closes early. Any Board member who hears about the closing will call the management liaison to verify.
Official Release
If the Office of Personnel Management begins an official release under the zone plan, the fitness center will close at the release time for Zone 1.
Liberal Leave
If liberal leave is in effect, STATS gym will be open regular operating hours.
Delayed Arrival
If a specific time has been stated in the delayed arrival announcement, the fitness center will open at that specific time. If no specific time has been stated in the delayed arrival announcement, the fitness center will open on time.
Other Emergency Conditions
If there are other emergency conditions, staff must call a minimum of two Board members, starting with the officers, before deciding to close the STATS gym.
Closure Guidelines
Temperature
If the temperature in the STATS gym is below 58 degrees, it may be closed on a temporary basis pending a firm estimate from GSA as to how long it will take to repair the problem. The staff member on duty will relocate to an office not affected by the cold temperature and monitor the situation. At this time, a sign will be posted on the door advising of the temporary closure of STATS gym. If it is determined that the problem cannot be fixed in a reasonable amount of time, STATS gym may remain closed. ABroadcast message sent to all headquarters employees and a notice posted on the STATS gym website and the gym’s front door will note “closed until.”
If the temperature exceeds 84◦F, members will be cautioned to adjust their workouts in response to the higher temperatures.
Water Availability
Unless the entire building is closed due to lack of water, the STATS gym will remain open. If no water is available, the showers and toilets will be closed, but the exercise area will remain open. If there is an issue with the water, a notice will be posted in STATS gym.
Security Issues
STATS gym will follow all general security guidelines established by the U.S. Bureau of the Census. In addition, the use of cellular telephones, cameras, and devices with video or photographic capabilities is not permitted in the locker rooms.
Staff Availability
In the event of an extreme emergency, when only one staff member is working and no other staff members are available for back up coverage, STATS gym will close, and a notice will be posted on the STATS gym front door.
Code of Conduct
• Follow the rules and regulations specified in the document and posted in the gym.
• Use equipment with care. Do not drop weights!
• Use gym wipes to wipe down exercise equipment after use, including weight benches, cardio equipment, exercise mats, etc.
• Return equipment to its proper place.
• Exercises deemed unsafe by the staff are not allowed.
• No harassment or abusive or derogatory language is permitted.
Prohibited harassment under the Code consists of unwelcome verbal or physical conduct or communication. Fitness Center membership carries with it the responsibility of appropriate conduct. Violation of any rules or other abusive or irresponsible behavior may result in one or more of the following:
• Verbal or written warning
• Restricted use of the facility
• Suspension of membership and/or fine
• Revocation of membership
