I request that applicable club fees be deducted from the above account by NC Fit Capital LLC d/b/a Fight Flow Academy by using electronic funds transfer. This includes current monthly dues, past due monthly payments, key fob deactivation fee ($25) and any taxes and applicable fees that may apply. This authorization for automatic drafts will remain in effect until I cancel my membership by providing a 30 day written notice via email or certified mail. At which point I will return my 24/7 key fob in working condition, or pay the $25 deactivation fee. I confirm that I am an authorized user of this account, and any subsequent accounts I may provide for automatic withdrawal, both under the terms of this agreement and with my financial institution. I confirm that NC Fit Capital LLC. is authorized to use the card listed on this agreement, as well as any subsequent cards I might place on file, for the use of good, services and any applicable taxes and fees. I agree to comply with the terms of this agreement as well as the terms provided by my financial institution. A $25 charge will automatically be applied for any late payments not remedied within 3 business days. A $25 charge will automatically be applied to any chargebacks that might occur that are not incompliance with this agreement. By initialing I agree that this account, and any accounts I might provide in the future, are authorized to automatically debit my membership dues until I cancel by submitting my written notice to cancel.
MEMBER’S INITALS:
BUYER’S INDEMNITY: Buyer assumes full responsibility for any person who becomes a member under this agreement and indemnifies the club, its affiliates, agents, owners, and employees against all liability arising from the member’s use of any and all of the facilities. PROPERTY LOSS OR DAMAGE: Members are urged not to bring valuables onto club premises and to keep valuables with them at all times. The club shall not be liable for the disappearance, loss, theft, or damage to personal property, including money, negotiable securities, or jewelry. Change in Facilities Classes and Operating Hours. As a result of repair, maintenance or special occasions, the club may be required to restrict the use or temporarily close one or more of the club’s facilities or activities from time to time. Management will make every effort to minimize any disruption to members during these periods and, if possible, to schedule any work during off-hours or summer months. The club may be closed for holidays, and may be closed for two weeks in the summer for renovations. Management may offer members the use of other conveniently located clubs during the period of unavailability. There will be no reduction, suspension or abatement of membership dues during such time when the above-mentioned occurs. Club hours of operation may be modified from time to time. The club reserves the right to change the facility, services, equipment and classes from time to time, to eliminate some or to add others. The club reserves the right to change the group exercise schedule, personal trainers and weight loss coaches, including: reassigning members to other trainers and coaches; and deleting classes and changing instructors, class times and length of classes. Certain classes may require an additional fee. Special Events: The club may from time to time reserve the use of its facilities for special events, competitions and private functions.
Interruption of Service. In case of a long term interruption of service (e.g. fire), the club reserves the right to: (1) freeze memberships and add the lost time once services resume; (2) transfer the member to another similar health club facility within afive-mile radius. In the event that an act of God (hurricane, earthquake, national emergency etc.), causes more than a temporary closing of the club, members’ dues obligations will be suspended until such time as use of the facilities can be resumed. Contractual dues obligations will otherwise not be affected unless the club cannot reopen within one year. Non Discrimination: The club represents that it will not discriminate against any person because of sex, race, creed, age, color, national origin or ancestry in considering applications for membership.
TERMS AND CONDITIONS
I understand and expressly agree that my use of this Fight Flow Academy facility, or any other Fight Flow Academy facility, involves the risk of injury to me or my guest whether caused by me or not. Such injuries may result from negligence, equipment failure, or human error. I understand that these risks can range from minor injuries to major injuries including death. In consideration of my participation in the activities and use of the facilities, exercise equipment, classes or services offered by Fight Flow Academy, I understand and voluntarily accept full responsibility on my behalf and on my guest’s behalf for the risk of injury or loss arising out of or related to my use or my guest’s use of the facilities, exercise equipment or participation in exercise programs or other services.
I agree that I acknowledge that Fight Flow Academy or any affiliates are not responsible for lost, damaged, or stolen items. I further agree that I am responsible for any damages to the facility or equipment directly caused by my misuse or negligence. I further agree that Fight Flow Academy, its affiliated companies and their respective officers, directors, employees, members, agents and independent contractors (collectively “Fight Flow Academy”) will not be liable for any injury, including, without limitation, personal, bodily, or mental injury, disability, death economic loss or any damage to me, my spouse or domestic partner, guests, unborn child, heirs, or relatives resulting from the negligent conduct or omission of Fight Flow Academy or anyone acting on Fight Flow Academy’s behalf whether related to exercise or not. Accordingly, to the fullest extent permitted by law, I do hereby forever release, waive and discharge Fight Flow Academy from any and all claims, demands, injuries, damages, actions or causes of action against Fight Flow Academy. I further understand and acknowledge that Fight Flow Academy does not manufacture fitness or other equipment or products available in its facilities, but purchases and/or leases equipment and therefore Fight Flow Academy will not be held liable for defective equipment or products. I understand this release of liability and assumption of risk agreement and I have been given the opportunity to ask questions related to my use of the facilities, exercise equipment, or my participation in exercise programs or other services. I further agree to comply with Fight Flow Academy’s membership policies and club rules that may be communicated to me from time to time either in writing, through club signage or verbally. Fight Flow Academy may, in its sole discretion, modify the policies and any club rule without notice at any time. Fight Flow Academy reserves the right to terminate my membership immediately for violation of any membership policy or club rule. Members are required to display their Membership Card and check in at the reception desk when entering the facility.
● Management reserves the right to refuse entry to any member or guest or to cancel a membership at any time and for any reason.
● We reserve the right to obtain new expiration dates from card issuers who make these dates available until you have cancelled in accordance with this agreement.
● All services are provided exclusively by employees or contractors of Fight Flow Academy (“Fight Flow Academy” or “Club”). Members and member’s guest may not provide services or solicit clients in club.
● Fight Flow Academy does not permit the use of facilities by minors under the age of 14 without a guardian being physically present at the club, assumes all liability, and cannot leave the minor unattended unless the minor is exercising with a Fight Flow Academy professional.
● The club may provide members with reciprocity privileges. The parent company may, from time to time, add new clubs and close existing clubs. Termination of any reciprocity does not entitle the member to dues credit or early cancellation rights or refunds. All members are restricted to their home club for the first thirty days of their membership term, unless special arrangements are made by the management.
CHANGE OF MEMBERSHIP POLICY
● Memberships can be frozen for a fee of $10 per month for up to 3 months per calendar year within written notice.
● 3 Business days notice is required to freeze an account.
● Freeze fees will not be accepted as the last month of dues.
● A 30 day written notice prior to the billing cycle will be required to cancel all existing memberships. Notice can be provided via e-mail or certified mail.
● Refunds will not be given for partial, expired or unused dues or private training packages.
● The last month's dues will be automatically drafted at the time notice is provided, although membership privileges will be provided for the entire duration of the paid amount.

I have read and agree to all the terms and conditions as set forth on the front and back of this agreement I certify, to the best of my knowledge, I am in good physical health and that there is nothing that would prevent me from engaging in the exercise programs or use of equipment or use of any treatment or service offered in the Club. I certify that I have read the section regarding the Club’s lack of liability and my assumption of risk. I agree that I am responsible for seeking training for any equipment or exercise with which I am not familiar.
