WAIVER AND RELEASE OF LIABILITY
In consideration of the risk of injury while participating at Coastal Fitness Center (the "Activity"), and as consideration for the right to participate in the Activity, I hereby, for myself, my heirs, executors, administrators, assigns, or personal representatives, knowingly and voluntarily enter into this waiver and release of liability and hereby waive any and all rights, claims or causes of action of any kind whatsoever arising out of my participation in the Activity, and do hereby release and forever discharge Coastal Fitness Center, located at 98 Quarter Horse Lane, Hampstead, North Carolina 28443, their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns, for any physical or psychological injury, including but not limited to illness, paralysis, death, damages, economical or emotional loss, that I may suffer as a direct result of my participation in the aforementioned Activity, including traveling to and from an event related to this Activity.
I am voluntarily participating in the aforementioned Activity and I am participating in the Activity entirely at my own risk. I am aware of the risks associated with traveling to and from as well as participating in this Activity, which may include, but are not limited to, physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and death. I understand that these injuries or outcomes may arise from my own or others' negligence, conditions related to travel, or the condition of the Activity location(s). Nonetheless, I assume all related risks, both Known or unknown to me, of my participation in this Activity, including travel to, from and during this Activity.
I agree to indemnify and hold harmless Coastal Fitness Center against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney's fees and any related costs, if litigation arises pursuant to any claims made by me or by anyone else acting on my behalf. If Coastal Fitness Center incurs any of these types of expenses, I agree to reimburse Coastal Fitness Center.
I acknowledge that Coastal Fitness Center and their directors, officers, volunteers, representatives and agents are not responsible for errors, omissions, acts or failures to act of any party or entity conducting a specific event or activity on behalf of Coastal Fitness Center.
I acknowledge that this Activity may involve a test of a person's physical and mental limits and may carry with it the potential for death, serious injury, and property loss. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, lack of hydration, condition of participants, equipment, vehicular traffic and actions of others, including but not limited to, participants, volunteers, spectators, coaches, event officials and event monitors, and/or producers of the event.
I acknowledge that I have carefully read this "waiver and release" and fully understand that it is a release of liability. I expressly agree to release and discharge Coastal Fitness Center and all of its affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns, from any and all claims or causes of action and I agree to voluntarily give up or waive any right that I otherwise have to bring a legal action against Coastal Fitness Center for personal injury or property damage.
To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence on the part of Coastal Fitness Center, its agents, and employees.
In the event that I should require medical care or treatment, I agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.
In the event that any damage to equipment or facilities occurs as a result of my or my family's willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any actions of neglect or recklessness.
This Agreement was entered into at arm's-length, without duress or coercion, and is to be interpreted as an agreement between two parties of equal bargaining strength. Both the Participant, , and Coastal Fitness Center agree that this Agreement is clear and unambiguous as to its terms, and that no other evidence will be used or admitted to alter or explain the terms of this Agreement, but that it will be interpreted based on the language in accordance with the purposes for which it is entered into.
In the event that any provision contained within this Release of Liability shall be deemed to be severable or invalid, or if any term, condition, phrase or portion of this agreement shall be determined to be unlawful or otherwise unenforceable, the remainder of this agreement shall remain in full force and effect, so long as the clause severed does not affect the intent of the parties. If a court should find that any provision of this agreement to be invalid or unenforceable, but that by limiting said provision it would become valid and enforceable, then said provision shall be deemed to be written, construed and enforced as so limited.

Release of Liability Waiver COVID-19
WAIVER: In consideration of being allowed to participate in any way in this program, related events, and activities, I, the undersigned, acknowledge, appreciate, and agree that: I knowingly and freely assume all such risk, even if arising from the negligence of the releasers, and assume full responsibility for my participation. I willingly agree to comply with terms and conditions for participa-tion. I HEREBY RELEASE, INDEMNIFY AND HOLD HARMLESS COASTAL FITNESS CENTER, AND/OR ITS EMPLOYEES.
By SIGNING this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I and my child(ren) may be exposed to or infected by COVID-19 by attending Coastal Fitness Center and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at Coastal Fitness Center may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Coastal FItness Center employees and members and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself or my child(ren) (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with our attendance at Coastal Fitness Center or participation in Coastal FItness Center programming. On my behalf, and on behalf of my chil(ren), I hereby release, covenant not to sue, discharge, and hold harmless Coastal Fitness Center, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Coastal Fitness Center, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after use of Coastal Fitness Center’s facility or participation in any Coastal Fitness Center activity.
Rules and Regulations for the Safety of our Employees and Members
1. All members are required to pre sign in using the Mindbody app for their workout time.
2. Members MUST wipe down machines and equipment after each use with the disinfecting wipes located around the gym.
3. When working out and using equipment members must remain 6 feet apart to adhere to social distancing guidelines. If using cardio or weight machines members must stagger use of machines. (every other machine)
4. No large social gatherings will be allowed at this time. To include no gathering at the smoothie bar after orders are made or gathering outside of the restrooms.
5. Water fountains will not be available for use of members or staff please bring your own water bottle.
6. All hand sanitizing stations around the gym will contain at least 60 percent alcohol and be readily accessible
7. All members must bring their own towels for use in the gym. Staff will not be able to provide them.
8. Anyone who has any potential symptoms of COVID-19, a fever or reports not feeling well will not be permitted to be at the gym.

Coastal Fitness Center Childcare Rules and Regulations
For your convenience we provide a service to care for and supervise your children during your workout time. We are not a full-service childcare center or licensed day care facility. In order to make our facility work more efficiently and with safety in mind, the following rules must be followed.
Sign in and Out
Please sign your child in upon arrival and out before leaving. The same person who signs your child in must sign them out. Once you have dropped off your child, we ask that you do not re-enter the room unless you have been paged. This will help relieve any anxiety they may have. When Child Care hours have ended, please arrive promptly to pick up your child.
Age Limits
Child Care is for children ages 3 months to 12 years. Children ages 3-6 months must be presigned in prior to arrival. This will help our staff prepare for your little one. If you come late or at a different time that you are not pre signed in for and there are other babies you will have to wait. Babies 3-6 months only get 1 hour, and parents must promptly pick up their babies. Once they turn 6 months, they will be able to stay the full 2 hours. Children under the age of 12 are not allowed to be on the workout floor. Parents may be asked to prove age.
No Germs, Please
If a child appears ill they will not be admitted into Child Care. You will be asked to provide a doctor’s note for allergies or symptoms that could be mistaken for an illness. Please label all belongings, diaper bags, and bottles with a permanent marker. Children are not allowed to bring toys from home. No outside food or drink is allowed.
Potty Time/Food
Children must be fully dressed at all times, including socks. Staff will bring your potty-trained child to the restroom but cannot assist children in the bathroom stall. Parents will be called if a child needs to be changed, fed, given medication, or is crying excessively.
Don’t Disappear
There is a two-hour time limit for the use of the Child Care facility (only 1 hour for babies 3-6 months). When not in Child Care, children are to be under parent’s constant supervision. Parents must be on the premises at all times while children are in Child Care. Parents must notify staff of their location in the gym in the designated spot on the sign in sheet.
No Violence Allowed
Children will be sent home for the following: foul and inappropriate language, fighting, inappropriate conduct, or any behavior that can be deemed violent or harmful to others. If a child bites once they will be given a warning. If a child bites or hits three times they will be suspended from the Child Care for 2 weeks.

PARENT & SWIMMER CODE OF CONDUCT
As a part of the Coastal Fitness Aquatics Program (CFAP), I form part of a swimming organization that believes in teamwork, integrity, respect and good sportsmanship before winning. By signing this Code of Conduct, I agree to follow the rules for behavior and sportsmanship while I am a member of CFAP. The following states the principles CFAP expects all its members to demonstrate and uphold at any time.
CFAP is fortunate to have experienced, professional coaches working to develop the children into better swimmers, and more importantly, teaching and instilling important life skills. Within these skills are included time-management, self-discipline and sportsmanship. Your child will harvest the benefits of swimming long after his/her participation within CFAP comes to an end.
As parents, it is essential that we give our coaching staff the respect and authority they deserve to run our swim team. Our coaches are hired for that purpose and the Head Coach oversees the direction of the staff.
PARENTS CODE OF CONDUCT
Always set the right example for the children by showing respect and common courtesy at all times to the team members, coaches, competitors, officials, parents, and for all facilities and other property used during practice or any meet.
Respect the integrity of swim officials by assuming decisions are based on honest, objective evaluations of performance. Only coaches may approach meet officials for any clarification of rulings.
Understand that other teams, including swimmers, coaches, loved ones, and fans want the same positive experiences for their swimmers as we do. Help us achieve the set goals by avoiding criticism either verbally or by gesture. Look for opportunities to build harmonious relationships with teams that we compete and train with.
Demonstrate good sportsmanship during all practices, meets and team activities. CFAP wins gracefully, loses graciously and congratulates their opponents either way.
Support your professional coaches as they strive to do what is best for each of our swimmers. Our expectations and methods are based on USA Swimming, the American Swim Coaches Association and other recognized swimming authorities. Realize that swimmers become easily confused when coached by parents and benefit most from positive reinforcement of the professional coaching staff’s instructions and advice. Your love and support before and after races will benefit them better.
Represent CFAP with excellence, respect, team spirit, good sportsmanship, and politeness.
If you have coaching concerns, address it respectfully with the appropriate coach in private. If you have club concerns, address it with the Aquatic Coordinator.
Maintain open and honest communication among all members of the CFAP family. We reach our common goals by working as a team.
Ensure that responses on any of the team's communications channels (voicemails, emails, Remind Me, Facebook, etc.) remain professional, respectful and be considerate.
Insist that your child refrain from using any alcohol, tobacco, drugs, other prohibited substances, violence, abusive or foul language, inappropriate sexual conduct or any other behavior deemed dishonest, discourteous, offensive or disrespectful of others.
PARENT RESPONSIBILITIES
Assist the coaches in conducting effective practices by ensuring swimmers arrive and leave on time, and bring the proper training equipment.
Arrive at meets in time for swimmer check in, stretching and warm-ups.
Know your role; Swimmers – Swim / Coaches – Coach / Officials – Officiate / Parents – Parent
Do not interrupt or confront the coaching staff on the pool deck during practice or meets, including not being present on deck during practice or competitions unless you are working at the meet. Coaches will be available before or after training and meets for feedback or to discuss any issues.
Assist the coaches by not talking with or motioning to swimmers during practices unless you have cleared it with the Head Coach first.
Do not speak harshly or directly to a child who is not your own.
Please contact a coach or one of our management team members if you have an issue with another parent's child. One of our managers or coach will approach the child's parent, if deemed necessary.
Always maintain positive self-control. Refrain from inappropriate behavior that diverts from a positive image of the team or is harmful towards our performance.
Be an active participant in all events, team activities, and encourage and support your child by ensuring your child is timely for all team events.
Trust and support both your swimmer’s and coach’s decisions with goal setting, training commitments, swim event entries, and meet schedules. Do not impose your ambitions on your child.
Any questions about disqualifications, judging, etc. should be directed to one of the coaches.
Pay your fees on time.
Know and uphold CFAP rules, regulations, management and coach directives, and by-laws that are designed to maximize the experience for all swimmers and parents.
SWIMMER CODE OF CONDUCT
The undersigned athlete participating with/for Coastal Fitness Swim Team (CFST) agrees to abide by the guidelines outlined below in addition to those established by the staff.
Swim for the fun of it, not just to please your parents or coach.
Make every team practice, meet and activity an opportunity to learn and grow not just as a swimmer but as a person.
Represent CFST with excellence, respect, team spirit and politeness.
Follow the directions of the coaching and management staff, respect official instructions and designated personnel. Disrespect or failure to obey instructions will not be tolerated at any moment from any athlete.
Always practice good sportsmanship to the team members, coaches, competitors, officials, parents and for all facilities and properties used during practices, competitions and team activities.
Be punctual and arrive on time for all practices, meets and events. Pool time is very valuable.
Attend all team meetings, practice sessions and swim meet (if registered for meets), unless excused by staff or have made special arrangements with the Head Coach.
Be an active participant in all team practices, meets, events and any team activities.
Swimmers must notify the coach, in advance, if they are planning to leave practice or swim meets early.
Wear CFST team caps at all practices and appropriate team swimsuits and caps at all swim meets. This displays team pride and makes it easier to identify swimmers on the blocks and in the water.
Focus on every drill and every set. Be committed to putting forth your best effort every day. An honest effort does not include cutting laps, pulling on lane lines or missing send offs or sets.
Disruption of practice by an athlete will be grounds for removal. Continual cheating in a practice will be considered a disruption of practice.
Pay attention and follow all the coach’s instructions completely and exactly. If clarifications are needed, ask questions courteously.
Use appropriate language. Use of profane, abusive language or obscene gestures will not be tolerated at any point in time.
Dishonesty, theft, and/or vandalism will not be tolerated and are grounds for removal. Indiscreet or destructive behavior will not be tolerated and are grounds for removal.
Every effort should be made to avoid guilt by association with such activities as those listed above.
There shall be no drinking of alcohol or use of tobacco products or illegal drugs or any substances banned by USA Swimming.
Swimmers are expected to respect each other. Fighting, intentional touching or striking another athlete will subject the swimmer to the most severe discipline.
Swimmers are expected to follow the spirit of the rules as well as the specific rules. The coach must adapt this to an infinite number of situations. Swimmers are asked to respect the coach’s directions and give their full cooperation. Cooperation with teammates and staff will produce a productive practice and competitive environment for everybody.
VIOLATION OF THE CODE OF CONDUCT BY SWIMMERS
The following penalties for violating the Coastal Fitness Swim Team's Code of Conduct include, but are not limited to, the following penalties:
The swimmer will be given a verbal warning.
The swimmer will be pulled out of practice in addition to a verbal warning and the coach will contact the parent.
Before coming back to practice, the swimmer will need to be accompanied by a parent and the parent stay for the duration of practice for four (4) consecutive days.
If the swimmer continues his/her bad behavior, he/she will be suspended for one (1) week (there will be NO prorated fee). If the swimmer's disciplinary problem continues, the swimmer and parent will meet with the coach to discuss the problem and possible solutions.
VIOLATION OF THE CODE of CONDUCT BY PARENTS
Violation by parents who fail to abide by the code of conduct, will be discussed and voted by the coaches and management team and may include, but not limited to, the following penalties:
The Board will give the parent a written warning.
The Board will inform parent that swimmer will not be allowed to practice in next four practices or next upcoming meet.
The Board will remove the parent and swimmer from the roster.
Parent/swimmer will be banned from joining CFST in the future.
Your acknowledgement during registration indicated, you have reviewed the Coastal Fitness Aquatics Program Code of Conduct with the registered athlete(s) and the athlete(s) understands the Coastal Fitness Aquatic Program Code of Conduct. You (the parent/guardian) and the swimmer(s) agree to abide by this Code and accept the penalties for not abiding by these rules. Any non-compliance may be subject to disciplinary action determined by the coaches and/or the management team, which may include expulsion from the team.
