The Member acknowledges and authorizes the Centre to extend the expiry date on the Member’s credit card in order to process the relevant dues payment. First month fees deduction will be on the starting date of your membership. Member is responsible and agrees that any delayed dues and bank charges prior to termination will be posted to Member’s account automatically.The Centre reserves the right to charge a late payment penalty equivalent to an amount of $10.70 (including Gst) for each delayed payment.

TERMS AND CONDITIONS OF MEMBERSHIP

1. Member’s Acknowledgement : The member agrees that he/she is of legal age and capacity and has voluntarily entered into this agreement or has obtained consent of the guardian to enter into this agreement. The member has read the terms and conditions herein and the center’s rules and regulations and accepts them as a legal and binding contract.
2.Type of Membership
2.1 Prepaid Membership: This membership is prepaid for the months stated in the membership details section of this agreement. This membership may not be terminated until the expiration of the commitment stated in the membership details section. The member shall not be entitled to any refund for any reason unless his/her membership is terminated in accordance with clause 6. below
2.2 Month to Month Membership : The Member agrees to pay the monthly dues by autopay and shall be allowed to terminate the Membership by giving 30 days advance notice before the next autopay deduction.no verbal request will be accepted and make sure there is no outstanding balance in your account. Your 30 days advance notice starts once our back office acknowledges your email/written request.
2.3 Giro/Dues Membership: The Member agrees that this Monthly Dues membership has a minimum contracted term stated in the membership details section. The member may not terminate this agreement until the expiration of the minimum contract term and full payment of the minimum contract term has been received by the Centre. Therefore, the Member further agrees that unless the membership is terminated in accordance with the Clause 6 of this agreement, this membership will renew automatically on a month to month basis at the same monthly dues rate stipulated in the Autopay section herein. The Centre is under no obligation to notify the member when the minimum contracted term is completed.
2(A) Memberships Series
2(A).1 Base/Basic/Beginners Seies :All membership under essential series are based on 2 classes weekly quota which can be spread out throughout the week however if your time doesn’t permit more then you can attend all 2 classes in a day.
2(A).2 Essential Series : All membership under essential series are based on 3 classes weekly quota which can be spread out throughout the week however if your time doesn’t permit then you can attend all 2 classes in a day..
2(A).3 Platinum/Daily/Advance series : All memberships in this series come with a weekly quota of 7 classes, allowing a maximum of 2 class bookings per day, without exceeding the total weekly limit of 7 classes.
2(A).4 Others :All memberships which are signed earlier or don't have any series mentioned in the contract will have no weekly/monthly/yearly quota.
2(A).5 Management reserves the right to make changes in above series or terms from time to time without notice . In case of dispute management, the decision will be final and binding.
3. Suspension of Membership by you
The member agrees that he/she shall not be entitled to suspend his/her Membership under any circumstance. However if you are a member in good standing,
1. You must give at least 15 days notice prior to your next scheduled autopay date for your suspension to be effective.
1.1 The minimum suspension period is one (1) month or maximum of three (3) months in any period of twelve (12) months . You are allowed to suspend your Agreement twice within any one (1) year.
1.2 Your membership may only be suspended for full months not partial months. If you have temporarily suspended your membership under this policy, you will not have access to use any of the PlatinumYoga’ facilities or livestream or recorded services during the membership suspension period.
2. All non pregnancy or non-medical suspensions will be charged monthly admin/suspension fees.
2.1 Suspension fees are non refundable and non transferable.
3. If you have a Giro/Dues Membership, You must complete minimum contracted term stated in the membership details section. Even though you are applying suspension in the middle of your contract, their will be no change in your monthly payment cycle. The package expiry date will be extended by the number of month (s) suspended.

4. If you apply for a medical or pregnancy suspension, you are required to provide a valid medical certificate that contains the date, your name, diagnosis, and the doctor's advice. PlatinumYoga reserves every right to reject your suspension if such medical certificate is invalid and to charge you admin per month.
5. No backdated suspension is allowed.
6. PlatinumYoga reserves every right to reject any suspension request at its discretion. Management reserves the right to make changes in above conditions from time to time without prior notice . In case of dispute management, the decision will be final and binding.
4. Rules & Regulations of Centre
In addition to the rules set forth herein, PlatinumYoga may, from time-to-time, post at PlatinumYoga’ facilities, or issue orally or in writing, additional rules that the members must obey for general safety reasons and mutually respectful use of the facilities.
PRESENTATION OF MEMBERSHIP CARD/ID :  You may be required to have your picture taken and kept on file for security reasons. To use a studio, you must present your membership card or other PlatinumYoga-specific identification for check-in at the front desk. If your membership card/ID is forgotten or misplaced, the picture on file will verify your identity or a valid form of identification may be required as membership and studio usage is not transferable. You may not allow any other person access to PlatinumYoga through the use of your membership (except when you are expressly permitted to bring guests). Doing so may result in suspension or cancellation/termination, with any outstanding balance immediately due and payable.
With respect to live streaming or pre-recorded membership options, sharing of your login information and multi user access to content is strictly prohibited and violation of this section will result in suspension or cancellation, with any outstanding balance immediately due and payable and any prepaid fees not subject to refund unless otherwise required by applicable law.
5. Compulsory Registration via online/in person for every activity/classes/workout :
Every member or trial pass holder is required to book every single class or activity he/she attends at PlatinumYoga. If Member is attedning 2 or more back to back classes/workout , he/sge must do the registration for both classes.
Any members found attending classes/workout/activity without registration and using someone else’s membership or account ID to visit or attend our classes is considered to have breached Platinum Yoga’s privacy policy. The member’s membership will be terminated with immediate effect without any refund.
6. Termination: Procedure and Policies
6.1 Termination by company PlatinumYoga may terminate your membership, in its sole discretion, if:
(1.1) you fail to make timely payments;
(1.2) your Payment Method is cancelled, interrupted or discontinued for any reason and you do not provide an acceptable alternative;
(1.3) you fail to follow any of PlatinumYoga membership policies or center rules/terms and conditions and regulation or violate any part of this Agreement; or
(1.4) your conduct is improper or harmful to the best interests of PlatinumYoga or its customers as determined by PlatinumYoga in its sole discretion. The Member has to pay for the full membership and shall not be entitled to any refunds.
(1.5) Company reserve the right to terminate membership with or without reason and with or without refund.
6.2 Termination by Member Due to Permanent Disability or Death Only In case of permanent disability, the Member will be entitled to claim a pro-rated amount by making a request for refund within thirty (30) days from the date of such disablement. Any such request for refund must be accompanied by a document in writing from a certified physician.The definition of permanent disability is a condition of non-temporary nature, which will preclude the member from physically using the yoga center facilities for the remainder of the term of the Membership and is documented in writing by a certified physician. The termination date will be the day the proof by the physician is submitted and received by The Company.The member agrees that the Membership shall not be terminated except by the Member in person. In case of death, the Membership shall be terminated and the Member’s family members will be entitled to make a joint application to claim a pro-rata amount within 30 days of such death. Such joint application must be accompanied by the death certificate of the Member.
6.3 Termination without cause :PlatinumYoga may terminate your membership without cause or for any reason not stated above.
6.3.1 Expulsion of Member
6.3.1(a) Platinum Yoga and/or the management may terminate the membership of any member:
(i) without notice and with immediate effect if the member’s conduct, whether or not such conduct is the subject of a complaint by another member or members, such that in the opinion of the management, and conduct may be injurious to the interests of the company.
(ii) without notice and with immediate effect if the member shall have committed any breach of these Terms and Conditions or of the Company’s Rules and Regulations that are in force at the material time.
(iii) if any monthly membership fees, locker fees, or service charges remain unpaid after the due date for payment
(iv) with and/or without notice and with immediate effect, if the company is of the opinion that the member is not a suitable individual for continued membership. management reserves the right to terminate without providing any explanation/ reason for termination. All decisions of the management under this clause are final and binding.

(v) without notice and with immediate effect if a member is found to have violated the privacy of any other member within the shower and the changing rooms, or are caught in lewd or compromising actions
6.3.1 (b) The company has the right to terminate any membership with or without notice/explanation. This may be done by refunding the prorated advance payment. A member whose membership is terminated by the management shall forfeit all the privileges of membership with immediate effect. On termination of his/her membership, the member shall return forthwith his/her membership card and any other evidence or property of membership provided to the member and shall settle any outstanding debts.
6.3.1 (c) Please treat our staff and fellow yogi members with respect. We aim to provide a safe environment for our staff and members, therefore, we expect all members to respect the rights of staff and of other members. The use or threat of force against our staff, or any attempt to do so, is unacceptable. This includes any forceful or unlawful touching of any other person, spitting at another person, raising fists or feet or verbally threatening to strike or otherwise applying force to any person. Aggressive or abusive behaviour against our staff is unacceptable. This includes swearing, threatening or abusive language or gestures, sexual gestures or behaviour, derogatory sexual or racial remarks, shouting loudly or in an intimidating manner or at any person, and applying force to any studio property or the personal property of any staff, such as banging on or kicking desks or counters. The company can terminate any membership with or without notice/explanation and with immediate effect if member is found to have been disrespectful to our staff.
6.4 Effective Date of Termination: In the event that PlatinumYoga choose to terminate your membership as set forth herein, such termination will be effective on the date PlatinumYoga mails a notice of such termination to your last known address, emails a notice of such termination to you at your last known email address or hand delivers a notice of such termination to you. You are liable for all financial obligations incurred prior to the date of the termination.
6.5 Effect of Termination: Upon cancellation or termination of membership, your right to use all PlatinumYoga facilities ends. If you owe any amounts to PlatinumYoga, PlatinumYoga will deduct such amounts from any refund owed. If there is not enough money in the refund to cover all amounts you owe, you must pay the balance or PlatinumYoga shall be permitted to charge your then current Payment Method for such amount.
7. Payment Obligations
The Member agrees that he/she will not be relieved of any payment obligations and no deduction or allowance will be made from any outstanding payments by reason of the Member's absence, failure to attend or non-usage of The Centre's facilities, change in classes, class title and/or teacher/instructor.
Failure to Pay on Time: You agree to pay a $10.70(including Gst) fee for any returned check or debit problems, such as insufficient funds, closed accounts, frozen or declined credit cards or similar circumstances. Any unpaid balance for membership fees, goods or services that is more than 30 days past due may result in automatic suspension of membership privileges. You agree to pay any collection and/or legal costs incurred by PlatinumYoga for collection of any amounts due. You hereby authorize PlatinumYoga to charge any undisputed balances and overdue amounts to your then current Payment Method.
Right to Modify Dues and Fees: PlatinumYoga reserves the right to modify your dues and/or fees (e.g. suspension, late fees, or otherwise) at any time upon any required legal notice periods. If you have a prepaid membership, PlatinumYoga may not modify the amount of your prepaid membership before the expiration of the current prepaid membership term.
8. Non-Refundable and Non Transferable:
8.1 : The member agrees that no refund (pro-rata or otherwise) will be made under any circumstances whatsoever including but not limited to any change in class schedules and/ or instructors and/ or provision of the facilities and/ or the member’s failure, absence, and/ or inability to attend or non-usage of the center’s facilities except if otherwise specifically agreed to in the terms and conditions of this agreement.
8.2: Non-transferability of Membership
The Member agrees that this Membership is not transferable.
9. Default
a. The Member will be in default if he/she breaches any of these Terms and Conditions herein/Company's Rules and Regulations as may be amended and applicable from time to time; or
b. If the Member fails to pay The Centre any fees and dues on time. If the Member is in default, his/her Membership privileges may be suspended and balance of the Membership Dues or any other fees payable by the member under this Agreement may become immediately due and payable at The Center’s option. Acceptance of any payment after default will not release the Member from any obligation under this Agreement to continue payment. The Centre reserves the right to charge a late payment penalty equivalent to an amount of $10.70 (including Gst) and other admin fees for each delayed payment.

c.With and/or without notice and with immediate effect, if the company is of the opinion that the member is not a suitable individual for continued membership. Management is not liable to give any reason for the same. All decisions of the management under this clause are final and binding.

10. Waiver:

The member hereby waives any and all claims or rights of whatsoever nature against the center. The member has carefully read and understood this clause and fully understands this as a release of any and all future claims of whatsoever nature including but not limited to injury or risk of injury or risk of abnormal changes from using the center's facilities and training.
10.1 HEALTH WARRANTY, ASSUMPTION OF RISK, WAIVER OF LIABILITY AND RELEASE  : By electronically signing or otherwise electronically accepting and agreeing to this Agreement, you expressly acknowledge that the use of the facilities, classes, or live streaming or video recordings of PlatinumYoga may involve strength, flexibility, aerobic, cardio and/or other exercises, including the use of equipment, as well as soft tissue manipulation or manual adjustments (which may include the instructor, assistant, trainee, or mentee guiding your body to a pose or specific movement), all of which can be potentially hazardous activities that naturally involve the risk of injury to you, whether you or someone else cause it, and you understand and voluntarily accept this risk. In addition, you represent that you are (and at all times moving forward when taking classes or receiving instruction by or through PlatinumYoga) in good health and have no disability, impairment, injury, disease or ailment that would prevent you from safely engaging in active or passive exercise or soft tissue manipulation or which would cause increased risk of injury or adverse health consequences as a result of engaging in active or passive exercise, and you further acknowledge and understand that it is your duty to notify your PlatinumYoga teacher in advance of each and every class of any changes in your good health standing). You acknowledge and agree that PlatinumYoga and its employees and agents do not diagnose or prescribe treatment for any illnesses or injuries. No service provided by PlatinumYoga is a substitute for medical treatment or care. Please inform your PlatinumYoga teacher in advance of each class if you prefer not to receive manual adjustments. Failure to do so will be deemed implied consent to receive manual adjustments in a class.
You hereby acknowledge and agree that PlatinumYoga will not be liable for any injury, including, without limitation, personal, bodily or mental injury, economic loss or any damage to you, your spouse or partner, guest, unborn child or relatives resulting from the negligence of PlatinumYoga, anyone providing services on PlatinumYoga behalf or anyone else using PlatinumYoga’ facilities or providing livestream or pre-recorded content and you release PlatinumYoga from any liability related to any such injury, including any transmission of sickness, virus, pathogen, or disease. You further acknowledge that some classes are held above room temperature (some above 100 degrees Fahrenheit), and that such heated yoga classes may be dangerous to your health, and as such you waive and release all cause of action related to such activity in heated classroom, including and regardless of any insured negligence during such heated activity. All sessions, classes, performance of any activities provided by PlatinumYoga whether in person, online, through video or stream or otherwise, or use of PlatinumYoga’ studio facilities (or entry/exit of such facilities), livestreaming or video, use of PlatinumYoga’ studio-provided equipment or apparatus (whether during a class or otherwise), or use of any other PlatinumYoga service shall be at your sole risk. You understand that the decision to use any equipment or apparatus, or the selection of programs, methods and types of equipment, shall be solely your responsibility, and at no time may you use any equipment without supervision by a PlatinumYoga teacher, and PlatinumYoga shall not be liable to you for any claims, demands, damages or causes of actions due to injury to you or your property arising out of or in connection with your use of the services or facilities of PlatinumYoga, or any occurrence in or around a PlatinumYoga facility, regardless of whether the injury or damages were caused by the negligence of PlatinumYoga, its employees or its agents. This waiver of liability and release specifically applies to claims of negligent instruction, maintenance, cleaning, and/or supervision that may arise as a result of injuries sustained before, during, or after classes or individual training sessions. Although PlatinumYoga instructors may provide guidance during a class or individual session, it is your sole responsibility to discontinue participation in any activity you feel is beyond your capability to safely perform and PlatinumYoga will not be responsible for any injuries or damages arising from your engagement in any activities at any PlatinumYoga’ studio regardless of whether they were caused by the negligence of PlatinumYoga, its employees or its agents, trainees, assistants, or mentees. You acknowledge and agree that this waiver of liability and release applies to any and all incidents occurring on any PlatinumYoga owned, operated or controlled premises, including slip or trip and fall incidents, regardless of the cause. You further acknowledge and agree that PlatinumYoga is not liable and does not assume responsibility for any claims, losses, damages, costs or expenses arising out of any inconvenience, loss of enjoyment, upset, disappointment, distress or frustration, whether physical or mental, resulting from any act or omission of PlatinumYoga or any other party. The scope of this waiver of liability and release specifically includes any and all injuries sustained in or about the premises of any PlatinumYoga facility and during any event or program organized or operated by PlatinumYoga away from its facilities, including, without limitation, parks, beaches, community centers and schools.
You expressly acknowledge and agree that by electronically signing or otherwise electronically accepting and agreeing to this Agreement you are relinquishing all rights you may have to sue PlatinumYoga for injuries arising out of the use of any PlatinumYoga facilities or its services.
This waiver of liability and release is intended to be interpreted as broadly as allowed under the law of the state/country where your primary PlatinumYoga facility is located.
10.2 WAIVER OF CLAIMS RELATED TO DEFECTIVE EQUIPMENT: You understand and acknowledge that PlatinumYoga does not manufacture any of the fitness or other equipment at its facilities, but purchases or leases equipment from third parties. As such, you acknowledge and agree that PlatinumYoga is solely providing recreational services and may not be held liable for defective products.
10.3 WAIVER OF CLAIMS FOR THIRD PARTY SUPPLIERS: From time-to-time, PlatinumYoga makes arrangements with accommodation providers, activity providers and other independent parties (“Third Party Suppliers”) to provide you with certain programming. Third Party Suppliers may also engage the services of local operators and/or subcontractors for the provision of services that form part of such programming. Although PlatinumYoga takes all reasonable care in selecting Third Party Suppliers, PlatinumYoga is unable to control Third Party Suppliers, does not supervise Third Party Suppliers and, therefore, cannot be responsible for their acts or omissions. Such services provided are subject to the conditions imposed by the Third Party Suppliers and their liability is limited by their tariffs, conditions of carriage, tickets and vouchers and international conventions and agreements that govern the provision of their services. These may limit or exclude liability of the Third Party Suppliers. You acknowledge that Third Party Suppliers are individually responsible to operate in compliance with the applicable laws of the countries in which they operate and PlatinumYoga does not warrant that any Third Party Supplier is in compliance with the laws of your country of residence or any other jurisdiction.
11. LOSS OR THEFT OF PROPERTY:
PlatinumYoga is not responsible for lost or stolen property. You are encouraged to keep valuables with you at all times when using any PlatinumYoga facilities. Lockers and storage spaces (including areas for mat storage) are offered without any representation that they will be effective in protecting valuables. The Centre accepts no liability for any items lost or stolen in The Centre.
12. Rules & Regulations of Centre:

In addition to the rules set forth herein, PlatinumYoga may, from time-to-time, post at PlatinumYoga’ facilities, or issue orally or in writing, additional rules that the members must obey for general safety reasons and mutually respectful use of the facilities.
13. Center’s Premises:
The center reserves the right to open new centers, relocate centers, close any center and/or close any of the center’s facilities or any part thereof by giving notice. The member agrees that he/she shall not be entitled to terminate the membership or claim a refund (pro-rata or otherwise) by reason of such happenings or in the events of any re-development/ acquisition of the Center by the landlord of the center or the relevant authorities.
14. Personal Data
1. The personal data provided by you means of this Agreement may be used by Platinum Yoga for processing applicants, reviewing your package, benefits or services, collection of Monthly Fees, Shoe Locker fees and other payments required under the Terms and Conditions or used in connection with the operations of Platinum Yoga for any related purpose.
2. The personal data given by means of this Agreement may be disclosed to any member of Platinum Yoga ’s associated companies, any agent, contractor or person who provides administrative, telecommunications, computer and other services to Platinum Yoga in connection with the operation of Platinum Yoga business.
3. You have a right of access and correction with respect to your personal data in accordance with the Personal Data (Privacy) Ordinance upon payment of a reasonable fee. Your right of access includes the right to obtain a copy of the personal data which you have provided by means of this Agreement. Centre reserves the right to charge a late payment penalty equivalent to an amount of $10.70 (including Gst) for each delayed payment.
15. Others:
LOST AND FOUND: You and your guests are not permitted to bring your own food or drinks into Platinum Yoga operated premises. 2. Lost property found on Platinum Yoga ’s premises will be held by Platinum Yoga for a period of (7) days, after such time Platinum Yoga reserves the right to dispose of the items in any way it sees fit, no claims shall be valid after this period.
GUESTS :Members may be allowed to bring guests under certain conditions, however, all guests must sign in at the front desk with photo identification (for in studio services) and sign a liability waiver prior to using PlatinumYoga’ facilities or streaming or recorded services.
DRESS CODE: Proper athletic attire is required. No street clothes or shoes are permitted in the fitness area unless expressly approved in advance by a PlatinumYoga employee. PlatinumYoga has the right to prevent participation in a class if proper attire is not worn.
PROHIBITED ACTIVITIES: Alcohol, drugs (including steroids), and smoking are prohibited within PlatinumYoga’ facilities. You agree not to use any PlatinumYoga facility or engage in any PlatinumYoga-related activity under the influence of drugs, alcohol or medication that may impair your ability to participate in the applicable activity or operate any equipment. No weapons of any kind are allowed. No photography, videotaping, filming or audio recording is permitted within PlatinumYoga facilities without the express written consent of PlatinumYoga management. PlatinumYoga reserves the right, in its sole discretion, to limit the consumption of food or beverages, or to the use of outside equipment within PlatinumYoga’ facilities. No recording of any livestream or pre-recorded content is permitted at any time without express written consent of PlatinumYoga. any breach of this restriction will entitle Platinum Yoga to immediately terminate this Agreement without refund.
At the conclusion of your use of a specific piece of equipment/mat/hammocks, yoga wheel etc you should wipe down the equipment with a hand towel.
OPERATING HOURS Platinum Yoga ’s normal hours of operation are indicated at Platinum Yoga ’s website. Platinum Yoga reserves the right to adjust the hours or to close Platinum Yoga (all or any part thereof) for cleaning, decorating repairs, maintenance, or for special private functions and holidays. However, Platinum Yoga shall endeavor to give reasonable notice of any alteration to the hours of operation or any closure of Platinum Yoga.
SOCIAL RESPONSIBILITIES : No person shall undertake any activity which, in the sole opinion of Platinum Yoga, is likely to annoy any other user of Platinum Yoga or which is unlawful.
CHILDREN'S USE : Children 12 years of age and older may participate in the generally available yoga/fitness classes when accompanied by a parent or legal guardian at all times provided a liability waiver has been signed by a parent or legal guardian unless otherwise expressly permitted by YogaWorks. Normal fees apply. PlatinumYoga reserves the right to discontinue usage for a child who is unsupervised.
OTHER ACKNOWLEDGEMENTS : You expressly acknowledge and understand that you will be automatically opted into communications from PlatinumYoga with regard to the services provided, branding, marketing, or anything else and that it is your duty to opt out through the procedures outlined in such communications. You further expressly acknowledge and understand that your photo and/or video likeness may be used, without limitation, in connection with publicity, copyright, marketing, web content, social media, live stream, recorded classes, or other uses and that permission is expressly granted for such uses, and that no additional consideration outside of the services provided by PlatinumYoga will be provided.

Management reserves the right of admission/selling/renewing contracts of services & products for whatever reason (provided/not provided), as they have a right to their premises/services as well as freedom of association.

16. Government law
This entire agreement is governed by law in Singapore.
17. Personal Data Protection Act (PDPA)
I understand and Acknowledge that I have provided Platinum yoga Pte Ltd, the above personal data of me, my family and/or friends with their consent and I am aware that the company will be contacting the said individual to assist them from time to time. For the purpose of the compliance with the personal data protection act (The "Act"), I agree to assist the company promptly with all access requests and complaints which may be received from the individual regarding the use of the personal data by the company.
18.Entire Agreement.
This agreement constitutes the entire and exclusive agreement between the parties. Any other agreement or promise which is not contained herein do not bind the Centre in any way and/or are hereby waived if any particular provision of this agreement is invalid, the same shall not affect the other provisions hereof.
Note that the Agreement between you and us will come into force upon you signing these Terms even if a Platinum Yoga Pte ltd Representative is not named or does not sign them.
By electronically signing or otherwise electronically accepting and agreeing to this Agreement on your own behalf or as the parent or legal guardian of a minor, you are certifying that you are at least 18 years old and that you have carefully reviewed, fully understand and agree to all provisions of this Agreement. Membership Agreement Checklist

I have received a copy of this Agreement.

I understand that I must show my Platinum Yoga Card/ ID (if asked by PY staff) on every visit and allow Platinum staff to take my photograph as verification of identity, which will be kept on Platinum’s system. I must never share my membership ID with anyone and never use anyone else ID.

I have purchased a Giro Membership Package of Minimum required months and I am committed to paying for monthly giro/autopay, I also understand that after these months I will be billed month to month autopay until I cancel my Agreement.

If i am purchasing a Giro/autopay membership , i am aware that i must have sufficient fund in my credit card for membership payment and update expiring credit card 2 months before expiration to avoid any late fees ($10.70 for each failed autopay). Late fees may be increased at any time at the discretion of the management.

Or I have purchased a Prepaid Package.

Platinum’s Suspension Policy has been fully explained to me as a detailed in Clause 3 of the terms & conditions of my agreement, and I understand it. I understand that backdated suspensions are not allowed.

Platinum’s Termination Policy has been fully explained to me and I understand that cancellation of my autopay/month to month autorenew membership requires me to give Platinum a written request thirty (30) days before my regular autopay deduction/billing date. If your notice is less then 30 days before the next autopay date, you will be charged 2 months of monthly fees before the packge is being termintaed. All termination must be processed by completing a Platinum Yoga Termination Form. If we have not received your termination request in writing, your contract will automatically continue after the minimum term period by billing you on autopay each month.If you are on suspension, full monthly fees will be charged for suspension period. All account balance must be settled before you submit for termination request.

I understand that if I book and do not show up for classes, my booking privileges may be suspended under its terms and conditions. The company has informed me that these rules may change periodically and all members will be informed through company’s website or others channels.

I understand and agree with all the terms and conditions, Privacy Policies , Studio rules and regulations, Events and Traning Terms and conditions , Membership agreement, Private Traning, Workshops, Retreats, Other Traning and Workshops and other products and services offer under "Platinum Yoga". Platinum Yoga reserve the right to periodically updates in both physical and online agreement without prior notice.

In respect to the account data, waiver data, and payment data (as defined below) that you provide to us, we are acting as a data processor on behalf of the service provider, who will be acting as the data controller in respect to such data. 1. How we use your personal data

1.1. This section provides you with information about:

a) what personal data we hold and process;

b) in respect of personal data that we did not collect from you directly, where we obtained that data from, and what types of data we have collected;

d) the legal grounds on which we process your data.

Members and end users of our services

1.2. Account data. We may process information about you that you provide to us when you first sign up with a service provider ("account data"). This account data may include your name, address, telephone number, email address, date of birth, gender, employment details, and a photograph of you. We may use this data to create your account with the service provider when you sign up. This account data may be updated each time you complete a document through our software. We do not process your account data in any other way, or have access to it in any way.

The legal basis for this processing is our legitimate interests in providing our services to our clients, and ensuring that your account is updated each time that you complete a document through our software.

1.3. Waiver data. If you are using our software in order to sign documents such as a waiver, health form, contract, or questionnaire, we may process information that you put into such documents (“waiver data”). This waiver data may include your name, signature, date of birth, email address, information about your health and medical history, and any other information that you are required or requested to put into the document.

Once you have completed the document, we will process it, convert the document into a different format, and send it to your account with the service provider in order for it to be stored. We will never store your data permanently on our systems (although it may be stored in your account with your service provider).

The purpose for our processing your data in this way is to maintain and administer a complete and accurate record of the documents that you have signed and completed for your service provider. The legal basis for our processing your waiver data (to the extent that such waiver data does not class as a special category of personal data), will be our legitimate interests in providing our services to our clients who have asked you to complete the document in question, in order to ensure that a complete and accurate record of your signing and completing the documents is maintained and administered.

1.4. Sensitive Personal Data. During the course of using our software and services and providing us with information in order for us to provide our services to you, you may provide us with sensitive information about yourself (“sensitive data”). This sensitive data may include your health and medical history. We may use this data for providing our services to you. However, we will only process this sensitive data if you consent to us doing so.

We comply with the requirements of the Children’s Online Privacy Protection Act. You must be at least 18 years old to have our permission to use the WaiverKing website. If you are between the ages of 13 and 17, or under the age of majority where you live, you represent that your legal guardian has reviewed and agreed to this privacy policy.

Other processing that we may carry out

1.5. Website data. We may process data about your use of our website and services ("website data"). The website data may include your IP address, geographical location, browser type and version, operating system, referral source, length of visit, page views and website navigation paths, as well as information about the timing, frequency and pattern of your service use. The source of the website data is our analytics tracking system. This website data may be processed for the purposes of analyzing the use of the website and services.

The legal basis for this processing is our legitimate interests, namely monitoring and improving our website and services.

We may also process this data for the purposes of diagnosing any issues we detect in relation to the use of our products or services. This data may be collected by our error-tracking software which is provided by Rollbar. We always try to ensure that any such data is anonymized so that you cannot be identified before it is stored in our records.

The legal basis for this processing is our legitimate interests in monitoring and improving our products and services.

1.6. Enquiry data. We may process information contained in any enquiry you submit to us regarding our products or services ("enquiry data"). The enquiry data may be processed for the purposes of offering, marketing and selling relevant products and/or services to you.

The legal basis for this processing is our legitimate interests, namely dealing with and responding to your enquiry appropriately.

1.7. Notification data. We may process information that you provide to us for the purpose of subscribing to our blog and press releases ("notification data"). The notification data may be processed for the purposes of sending you newsletters.

Where you are a corporate customer, the legal basis for this processing is our legitimate interests, namely the marketing of relevant products and services to you.

1.8. Correspondence data. We may process information contained in or relating to any communication that you send to us ("correspondence data"). The correspondence data may include the communication content and metadata associated with the communication. Our website will generate the metadata associated with communications made using the website contact forms. The correspondence data may be processed for the purposes of communicating with you and record-keeping.

The legal basis for this processing is our legitimate interests, namely the proper administration of our website and business and communications with users.

1.9. Payment data. We do not process payment information relating to goods and services that you purchase from the service provider. However, we do capture certain data relating to your payments and use them to update your account with the service provider ("payment data"). The payment data may include your contact details, your card details and the transaction details. The payment data may be processed for the purposes of updating your account with the service provider. The legal basis for this processing is our legitimate interests, namely our interest in the proper administration of our software and ensuring your account with the service provider is updated.

1.10. Other processing activities. In addition to the specific purposes for which we may process your personal data set out above, we may also process any of your personal data where such processing is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.

2. Providing your personal data to others

2.1. To our clients and partner service providers. The only third parties that we will disclose your personal data to are our clients (your service provider) who is the data controller in respect to the account data, waiver data, and payment data that we collect about you, and MINDBODY Inc. (“MINDBODY”), who provide software services to service providers in conjunction with the WaiverKing software. Your accounts are created by WaiverKing in the MINDBODY software on behalf of our clients.

2.2. Our insurers/professional advisers. We may disclose your personal data to our insurers, legal counsel, and/or professional advisers insofar as reasonably necessary for the purposes of obtaining and maintaining insurance coverage, managing risks, obtaining professional advice and managing legal disputes.

2.3. Where we provide your personal data to any third party. Where we share your personal data with any of the third parties referred to above, we will ensure this processing is protected by appropriate safeguards including a suitable data processing agreement with that third party.

2.4. To comply with legal obligations. In addition to the specific disclosures of personal data detailed above, we may also disclose your personal data where such disclosure is necessary for compliance with a legal obligation we have to comply with, or in order to protect your vital interests or the vital interests of another individual. This may include disclosing your personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

2.5. We take reasonable and appropriate steps to ensure that third-party agents and service providers process your personal data in accordance with our Privacy Shield obligations and to stop and remediate any unauthorized processing. Under certain circumstances and pursuant to applicable laws, we may remain liable for the acts of our third-party agents or service providers who perform services on our behalf for their handling of your personal data that we transfer to them.

3. Transfers of your personal data outside of the European Economic Area

As further detailed below, we may transfer your personal data to our servers based in the US, as we are part of the Privacy Shield. Otherwise, where your personal data is transferred outside of the EEA, we will ensure that either (a) The European Commission has made an "adequacy decision" with respect to the data protection laws of the country to which it is transferred, or (b) we have entered into a suitable data processing agreement with the third party situated in that country to ensure the adequate protection of your data. In all cases, transfers outside of the EEA will be protected by appropriate safeguards.

4. Retaining and deleting personal data

4.1. Personal data that we process for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes. Details about members of our clients (your service provider) and end users of our services, including the account data, waiver data and sensitive personal data, will not be stored by WaiverKing.

4.2. Unless we contact you and obtain your consent for us to retain your personal data for a longer period, we will retain and delete your personal data as follows:

a) Website data will be retained for 12 months following the date of our last contact or dealing with you, at the end of which period it will be deleted from our systems.

b) Enquiry data will be retained for 12 months following the date of our last contact or dealing with you, at the end of which period it will be deleted from our systems.

c) Notification data (other than Notification data that is also Contact data) will be retained for 12 months following the date of our last contact or dealing with you, at the end of which period it will be deleted from our systems.

d) Correspondence data will be retained for 12 months following the date of our last contact or dealing with you, at the end of which period it will be deleted from our systems.

4.3. We may retain your personal data where such retention is advisory and/or necessary for compliance with a legal obligation to which we are subject (such as with regard to applicable statutes of limitations, litigation or regulatory investigations), or in order to protect your vital interests or the vital interests of another natural person.

5. Your rights

5.1. You may instruct us to provide you with any personal information we hold about you; provision of such information will be subject to:

a) your request not being found to be unfounded or excessive, in which case a charge may apply; and

b) the supply of appropriate evidence of your identity (for this purpose, we will usually accept a notarized photocopy of your driver’s license and/or passport and an original copy of a utility bill showing your current address).

5.2. We may withhold personal information that you request to the extent permitted by law.

5.3. You may instruct us at any time not to process your personal information for marketing purposes.

5.4. In practice, you will usually expressly agree in advance to our use of your personal information for marketing purposes, or we will provide you with an opportunity to opt out of the use of your personal information for marketing purposes.

5.5. Your right to access your data. You have the right to ask us to confirm whether or not we process your personal data and, to have access to the personal data, and any additional information. That additional information includes the purposes for which we process your data, the categories of personal data we hold and the recipients of that personal data. You may request a copy of your personal data. The first copy will be provided free of charge, but we may charge a reasonable fee for additional copies.

5.6. Your right to correct. If we hold any inaccurate personal data about you, you have the right to have these inaccuracies corrected. Where necessary for the purposes of the processing, you also have the right to have any incomplete personal data about you completed.

5.7. Your right to erasure. In certain circumstances you have the right to have personal data that we hold about you erased. This will be done without undue delay. These circumstances include the following: (1) it is no longer necessary for us to hold those personal data in relation to the purposes for which they were originally collected or otherwise processed; (2) you withdraw your consent to any processing which requires consent; (3) the processing is for direct marketing purposes; and/or (4) the personal data have been unlawfully processed. 5.13. Automated data processing. 5.17. Exercising your rights. You may exercise any of your rights in relation to your personal data by written notice to us in addition to the other methods specified above.

5.18. Point of Contact Data. PARAGRAPHS 5.1 – 5.17 SHALL NOT APPLY TO ACCOUNT DATA, WAIVER DATA, OR PAYMENT DATA OBTAINED OR PROCESSED BY WAIVERKING. IN RESPECT OF SUCH DATA:

a) WAIVERKING IS ACTING AS A PROCESSOR OF THAT DATA AND THE MAIN CONTRACTOR IS THE CONTROLLER;

7. Security of Your Information. The security of personal data is a high priority at WaiverKing. We seek to use reasonable technical, administrative and physical safeguards to protect personal data within our organization. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. As a result, while we strive to protect your personal data, you acknowledge that: (a) there are security and privacy limitations of the Internet which are beyond our control; (b) the security, integrity, and privacy of any and all information and data exchanged between you and us through the website cannot be guaranteed; and (c) any such information and data may be viewed or tampered with in transit by a third party.

10.6. WaiverKing Inc. is controlled and operated by us from the United States. Except where you are a resident of a Member State of the EU, in which case paragraphs 2 and 3 above will apply, your personal data may be stored and processed in any country in which we engage service providers, and by using WaiverKing’s services you understand that your information may be transferred to countries outside of your country of residence, including the United States, which may have data protection rules that are different from those of your country.
